Gary Growe again recognized in Missouri Lawyers Weekly for exceptional case results

July 2012 and August 2012 editions of Missouri Lawyers Weekly highlight Gary Grow’s accomplisments.

A $750,000 settlement was reached for a client who was struck by another cyclist while riding her bicycle in Creve Coeur Park. She suffered brain injuries that she alleged greatly diminished her earning capacity. She sued the other bicyclist and ultimately the case settled in mediation.

Growe said that an economist found that the injuries and subsequent reductions in cognitive functioning reduced the plaintiff’s earning capacity to $20,000 a year, when at the time of the accident she had been earning $64,000 working in information and security management.

In another case, an arbitrator ruled in favor of a company that claimed it hadn’t accepted the online terms and conditions in a breach of contract case. Plaintiff Sasso America was awarded $65,000. “This case presents a good warning for all lawyers dealing with client contracts entered into via the Internet, which impose terms and conditions either different from or otherwise simply unknown to the contracting party,” Growe said.
